Distance Selling Agreement

ARTICLE 1 – PARTIES

BUYER: The person placing the order (the information provided in the membership/order form applies.)

ARTICLE 2 – SUBJECT

This Distance Selling Agreement regulates the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts. The buyer accepts and declares that they have read and are aware of all preliminary information regarding the basic characteristics, sales price, payment method and delivery of the product subject to sale, and that they have given the necessary consent electronically.

ARTICLE 3 – PRODUCT INFORMATION

The type, quantity, and VAT-inclusive sales price of the product(s) subject to the contract are specified on the order page. The basic features of the product (including type, quality, quantity and price information) are available on the seller's website.

ARTICLE 4 – GENERAL PROVISIONS

  • The buyer accepts that they have read and are aware of all preliminary information regarding the characteristics, sales price, payment method and delivery of the product subject to the contract.
  • The product subject to the contract shall be delivered to the buyer or the person/organization at the address indicated by the buyer, within the legal 30 (thirty) day period, and for made-to-order products within 6 weeks.
  • The seller cannot be held responsible if the person/organization to whom the product is to be delivered does not accept the delivery.

ARTICLE 5 – DELIVERY CONDITIONS

Delivery is made to the address specified by the buyer in the order form through the contracted cargo company. Delivery time is 3-5 business days for in-stock products and 3-6 weeks for made-to-order products from the order confirmation. Shipping costs are covered by the seller (free shipping).

ARTICLE 6 – PAYMENT METHOD

The product price is collected during ordering via credit card/debit card through iyzico secure payment infrastructure. All prices include VAT and are stated in Turkish Lira (TL).

ARTICLE 7 – RIGHT OF WITHDRAWAL

  • The buyer may exercise the right of withdrawal within 14 (fourteen) days from the date of delivery of the product to themselves or to the person/organization at the indicated address, without giving any reason and without paying any penalty.
  • To exercise the right of withdrawal, it is sufficient to notify the seller via email (contact@ayanastudioist.com) within this period.
  • The product to be returned under the right of withdrawal must be unused, with its packaging unopened and undamaged.
  • Return shipping costs are borne by the buyer.
  • The product price will be refunded to the buyer within 14 days following the exercise of the right of withdrawal.

ARTICLE 8 – PRODUCTS FOR WHICH RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

Pursuant to Article 15 of Law No. 6502 and the relevant regulation, the buyer cannot exercise the right of withdrawal in the following cases:

  • Products prepared at the buyer's request or clearly for personal needs, made-to-order (custom design) products.
  • Products whose packaging has been opened, used or damaged after delivery.

ARTICLE 9 – COMPETENT COURT

In disputes arising from this contract, Consumer Arbitration Committees have jurisdiction up to the value announced by the Ministry of Customs and Trade, and Consumer Courts have jurisdiction for disputes exceeding this value. By approving this contract electronically, the buyer is deemed to have accepted all articles.
